Widow's Claim for Pension. The State of Tennefsee, County of Greene, SS. On this 18th day of June, A.D., 1865, per- sonally appeared before me E.M. Moore Justice of the Peace a Court of Record within and for said county, Nancy Cox, aged 35 years, a resident of 7th District, in the county of Greene, and State of Tennessee, who, being first duly sworn ac- cording to law, doth, on her oath, make the following declaration, in order to obtain the benefit of the provision made by the act of Congress approved July 14, 1862: [space left blank] That she is the widow of Horton Cox, who was a Private in Company A, commanded by Captain Harel, in the 12th Regiment of Tennefsee Cavalry, commanded by Col. Spaulding, in the war of 1861. [Space left blank]. That her husband died at Nashville, in the State of Tennefsee, on the 3rd day of July A.D. 1863 of Fever Contracted while in the line of duty in the service of the United States. She further declares that she was married to the said Horton Cox, in Greene County, on the 15th day of September A.D., 1849, by one William. M Williams, a Justice of the Peace; that her name before her marriage was Nancy Jones, and that ever since the death of her said hus- band, she has remained a widow: as will more fully appear by reference to the proof an- nexed. She presents the public record as proof of marriage and the affidavit of two witnefses as to present widowhood. That during the existence of the aforesaid marriage there were born to her and her said hus- band the following named children, who are now under the age of sixteen years, viz: Lemuel, born the 27th day of March, 1851; Amanda " " 18th " " December 1852 Phebe " " 9th " " December 1854 Francis M " " 10th " " April 1860 Martha J " " 3d " " October 1862 all of whom are still living, and reside in Greene County. She also declares that she has in no manner been engaged in, or aided or abetted, the Re- bellion in the United States. State of Tennessee, County of Green SS. On this 24 day of Dec. A.D. 186 , personally appeared before me Clerk of the County Court, a Court of Record, within and for the County and State aforesaid, Mrs. Nancy Cox a resident of the County of Green in the State of Tennessee aged 36 years, who, being first duly sworn according to law, doth on her oath make the following declaration, in order to obtain the benefit of the provision made by the act of Congress, approved July the 14th 1862 + 181. That she is the widow of Horton Cox deceased, who was a Private in Company A commanded by Captain Harrell in the 12 Regiment of Tennessee Cavalry commanded by Colonel [space left blank] in the war of 1861, and who died while in the service aforesaid, at Nashville in the State of Tennessee on or about the third 3d day of July A.D. 1863, from the effects of Typhoid fever incurred in the service aforesaid and while in the line of his duty, [space left blank] She further declares that she was married to the said Horton Cox in the County of Green in the State of Tennessee on the 11th day of September in the year 1849; and that her name before her said marriage was Nancy Jones that her husband, the aforesaid Horton Cox died on the day above mentioned, and that she has remained a widow ever since that period, as will more fully by reference to the proof herewith accompanying or to be hereafter filed. She also declares that she has not, in any manner, been engaged in, or aided or abetted, the rebellion in the United States. She irrevocably appoints Butter + Smith of Knoxville her attorney, with full power of substitution and revocation on his part in her said behalf, and authorizes them to receive the Pension Certificate when issued. Her Post Office is at Romio in the County of Green in the State of Tennessee. That her domicile or place of abode is on the wagon road leeding from Bulls Gap to Babbs mill and about 11 miles from Greenville her County seat. Lane who was Recruting for the US sevace on or about the 29th day of March 1863 and was in the sevace on duty up to about the 31st day of July 1863 when he the said Horton Cox died at Nashville State of Tennessee of Dirarhea a dissease which he contracted while in the sevace and while in the line of his duty, after said Horton Cox died said Company was mustered and said 6th and 12 Regt was consoladated and thrown together and from and after that date which was on or about the 24th day of August 1863 said Regt was mustered and known as the 12th Tennessee Cav Vol said Cox died before he was mustered and. his name was not cared up by the mustering officer all these statesments these affiants makes from Personal knowledge having enlisted and Sworn in the sevace at the same time and place by the same Recruting office (Capt Lane) and assigned to the same Co + Regt with Said Cox [seems to be page missing - no signatures] ______________________________________________________________________ __ [5.] State of Tennessee) Green County ) Before me E.M. Moore a Justice of the peace in and for said county Personally appeared Nancy Cox widow of Horton Cox and makes oath that this only explenation she can give in regard to the discrepency in the name of her Second child named in her decleration for pension is she is no schollar herself, and did not know how the name of sd child was written wither in the original decleration or Suppemental affidavit she first gave the name of sd child to the person who made out her decleration did not know how he spelt it, and when her Supplemental affidavit was made up she handed the person who made it up her family Record and from that the names of the children was taken, and on now being called on for this explination she has the name cearfully examined, and find it Spelt Manday which is the way the father of said child did Spell it as he did write the names in the family Record the affiant further swers that in making proof of the death of her Late husband she knows of no medcle testimony that can now be had as he died at Nashville Tenn some over three hundred miles from this affiant and dose not know who or where the Physician was or one if any where [pg. 2] might attended him she herewith encloses the best proof as to date and cause of death that she can get and Relies on it for satisfactory evedence as to the same. Cav. Volunteers. On the Muster Roll of said Company, for the months of May and June, 1864, he is reported sick in Hospital at Nashville, Tenn. Settlement await= ing proof of death. Moore who was Late 2nd Lieut Co A 12 Regt Tenn Cav__ Vol. and that he was personally acquainted with Horton Cox Late Private Co A 12 Regt Tenn. Cav. Vol. and who was taken Sick with what was called Camp fever + diarhea on or about the last of May or first of June 1863 At Camp Quinn Tenn. while his Command was at Quinn Tenn, while he was with his Command and whild in the Line of his duty he was in the Hospl, at Quinn for a short time after taken sick, from which place he was sent to the Hospl at Nashville Tenn at which place he died on or about the 3rd July 1863 of said dissease aforesaid named This affiant further states on his oath that he dose not know of any Medicle testimony that can now be had as to the sickness and death of said Horton Cox, and that sd Horton Cox was a man of good Morel habits and sd dissease was not induced or aggrevd by any personal Habits of said Soldier all these Statement is made from personam knowledge as this affiant was with his [pg. 2] Command at the time sd Cox was taken Sick and that his Command had moved from Quinn To Nashville Ten before sd Cox died, was there at the time of his death and further this affiant has no interest in this claim. I certify that Nancy Cox widow of Horton Cox who was a Private Co D 1st Reg't Tenn Cav Vols., in the service of the United States, is entitled, under the provisions of an amend= ment to the act of July 14, 1862, to receive pay at the rate of Eight dollars per month, to commence on the Fourth day of July, 1863, and to continue during life, unless she shall again marry, in which case the pension to her and for the within named children is not payable after the date of such marriage. Also, there shall be paid to the widow on account of the following named children, to commence 25th July 1866.
