The 5th Tennessee Infantry (Union) was described as a Blount County unit. Robertsville. Death has torn from our midst two friends. The soul of Thomas Reed left its mortal home on Friday last. On Sunday morning, Mr. John Peters, was claimed by the ruthless enemy. The heart-felt sympathy of the community is extended to their bereaved families. While you weep, dear ones, let your soul rejoice over the hope of an eternal meeting in heaven. (He died on 8 Mar 1890, which was actually a Saturday.)

The following is from the Civil War Pension application of John H. Peters and later of his widow Hulda Asberine (Asberine) Peters. John's application was first filed on 17 Mar 1888. He died on 8 Mar 1890, and Asberine's application as a widow was first filed on 14 Apr 1890.

Asberine's application documents her minor children who were still living. The primary source we have for her children is a Peters family history that was taken from the Peters family bible. The children as listed in Asberine's pension application are consistent with the children listed in the family history.

Declaration for Original Invalid Pension. State of Tennessee County of Anderson. On this 17 day of March, A.D. one thousand eight hundred and eighty 6 personally appeared before me R.C. Dew Clerk, of the County Court, a court of record within and for the County and State aforesaid, John H. Peters, aged 43 years, a resident of County of Anderson State of Tennessee, who, being duly sworn according to law, declares that he is the identical John H. Peters who entered service under the name of John H. Peters on or about the 18" day of July 1862 as Private in company K of the 5' regiment of Tenn Vols and was DISCHARGED at Nashville, Tennessee, on or about the 12" day of June, 1865, by reason of telegram from War Department; that his personal description is as follows: Age, 43; height, 5 feet 8 inches; complexion, dark; hair, auburn; eyes, gray. That while a member of the organization aforesaid, in the service and in the line of his duty near Wilmington, in the State of North Carolina, on or about Feby, 1865, he contracted disease of the spine from exposure and hard marching. At Marietta Ga August 1864 he contracted fever and ague from exposure. That he was treated in hospitals as follows: hospital at Marietta Ga. That he has not been employed in the military or naval service otherwise than as stated above. That since the 12" day of June, A.D. 1862, he has not been employed in the military or naval service of the United States. That since leaving the service his occupation has been that of a Farmer. That prior to his entry into the service above named he was a man of good, sound, physical health, being when enrolled a Farmer. That he is now disabled from obtaining his subsistence by manual labor by reason of his injuries above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid pension roll of the United States. He hereby appoints, with full power of substitution and revocation, George E. Lemon, of Washington, D.C., his true and lawful Attorney, to prosecute his claim. Sir: I have the honor to request that you will furnish from the records of the War Department a full Report as to the service, disability and hospital treatment of John H. Peters, who, it is claimed, enlisted July 18, 1862, and served as Private in Co. K, 5 Reg't Tenn. Vols and was discharged at Nashville, Tenn, June 12, 1865. While serving in Co. K, 5 Reg't Tenn Vols he was disabled by fever and ague or malaria at Marietta Ga Aug. 1864, also disease of spine near Wilmington, N.C. Personally came before me, a acting Justice of Peace in and for aforesaid County and State, George Grills aged 41 of Scarborough, Anderson Co Tenn a person of lawful age, who, being duly sworn, declare in relation to the aforesaid case as follows:
in the year 1880 first thing the above soldier moved on my farm in Anderson Co Tenn as a renter & has lived with me until the present time living in 1/4 mile of a mile of my house I have heard claimant complaining of diseas of the spine for six years the time he has lived with one I have seen him confined to his bed or house at least 12 or more times in the last 6 years some times treated by the Dr other times not & always puny & complaining & not able to do good work at any time During the 6 years I have saw on a average onct a day Since he has lived With me I am Satisfied the claimant has been at least 3/4 disabled from manual labor Since he has lived with me.

Volunteers, was enrolled on the 13" day of July, 1862, at Camp Morgan for 3 yrs, and is reported: On Roll from enrollment to Agu. 31st, 62, present. Same to Feb. 29", 64. March & April, and May & June, 64, not on file. Returns for these months do not show him absent, July and Aug, 64, present, and so reported to April 30"/65.
He was mustered out with Det. of Co. at Nashville, Tenn., June 12th, 1865. Reqtt Hospital Records are not on file. The records of this office furnish no evidence of alleged disabilities.

Rerating, and Increase of pension.
State of Tennessee County of Anderson on this the 30 day of April 1888 personally appeared before me the undersigned duly authorised to administer oaths within and for the county and state aforesaid John H. Peters aged 45 years a resident of the county and state aforesaid who being duly sworn according to form declares that he is a pensioner of the united States duly enrolled at the rate of $4 dollars per month under pension certificate no. 389.824 by reason of a disability from malarial poison resulting in dyspepsia which causes inability to perform any hard manual labor incurred in the servis of the united states while a priv in co k 5 Tennessee vol inf that he believes himself to be entitled to an Increase of pension on the account of his rateing unjustly low and disproportional to his degree of disability.
He claims during the time from his fileing his original declaration for pension to the date his rate has not been in accordance with his Disability nor in proportion to the rate allowed to others for similar and equivalent disabilities and therefore he asks that his rating be corrected and be rerated from his former fileing to Date in accordance with law. That his postoffice is Scarborough county of Anderson State of Tennessee. John H. (his mark) Peters.

Widow's Declaration for Pension or Increase of Pension. This must be Executed before a Court of Record or some Officer thereof having Custody of the Seal, State of Tennessee, County of Anderson: On this 14 day of April A.D. one thousand eight hundred and ninety personally appeared before me S.M. Leath Clerk of the County Court a Court of Record within and for the County and State aforesaid Hulda A. Peters aged 45 years, who, being duly sworn according to law, makes the following declaration in order to obtain the Pension provided by Acts of Congress granting pension to widows: That she is the widow of John H. Peters, who enlisted under the name of John H. Peters on the 13 day of July A.D. 1862 in Co K 5 Regiment Tennessee Vol Inf. in the war of 1861&5 who contracted malarial poisoning and resulting dispepsia caused by exposure in camp life which was the sequence of John H. Peters Death on the eighth day of March AD. 1890 who bore at the time of his death in the rank of priv disc in Nashville Tennessee June 12 1865, that she was married under the name of Huldy A Cross to said John H. Peters on the 24 day of August A.D. 1865 by John Gamble JD at Scarborough Tenn there being no legal barrier to such marriage; that neither she nor her husband had been previously married that she has to present date remained his widow; that the following are the names and dates of birth of all his legitimate children yet surviving where were under sixteen years of age at father's death, viz:

Tennessee and Marthy E Cross aged 38 years, a resident of Scarborough in the County of Anderson and State of Tennessee whose Post Office address is Scarborough Anderson Co Tennessee well known to me to be respectable and entitled to credit, and who being duly sworn, declare in relation to the aforesaid case as follows: That they have been well and personally acquainted with the claimant for 30 years, and 21 years respectively, and that in regard to the birth of John W. Peters I Mary J. Grills was present at the birth of claimants son John W. Peters on the 16 day of March 1877 my reason for knowing the above date of birth of J W Peters is my daughter Mary E birth & age being born 6 years to a day prior to the birth of J W Peters to the best of my recollection & belief.
I M.E. Cross was present as a neighbor at the birth of John W. Peters son of John H. & Hulda A Peters on the 16 day of March 1877 me reasons for remembering the above dates is from the birth of one of my own children.
We further state that Nancy Gibson was present as midwife at the birth of John W. Peters son of John H. & Hulda A. Peters further states that Nancy Gibson Died on or about 15 of June 1883.

Keith aged 48 years, a resident of Scarborough in the County of anderson and State of Tennessee whose Post Office address is Scarborough anderson co Tenn well known to be to be respectable and entitled to credit, and who being duly sworn, declare in relation to the aforesaid case as follows: That they have been well and personally acquainted with John H & H A Peters for 26 years and 26 years respectively, and that in regard to the matrimonial services between John H Peters & Hulda A Cross We were present & saw them united together as man & wife by Squire John Gambel Who Was a acting Justis of the peace at that time for the county of Anderson & state Tennessee on the 24 Day of August 1865 my reasons for knowing S.E. Shannon I remember M.E. Keith birth day being on the 24 of August & I know the years was 1865 I M.E. Keith remember from my Birth Day being aug 24.

Declaration for Soldiers' Children Who Are Permanently Helpless. Act of June 27, 1890. State of Tenn, County of Anderson, on this 30 day of January, A.D. one thousand nine hundred and four, personally appeared before me, a Justice of the Peace of the State of Tenn, in and for the County and State aforesaid Mrs. Hulda A. Peters aged 58 years who being duly sworn according to law, makes the following declaration in order to obtain the pension provided by Act of Congress approved June 27, 1890; That She is the mother of Martha E. Peters, and has charge and custody of the same, who is at the present time suffering from Paralysis of her left side, nearly loss of sight of both eyes, and Epilepsy which said disability, to her best knowledge and belief is permanent in its character and renders the said child permanently helpless. That Martha E Peters is the legitimate child of John H. Peters, who enlisted under the name of John H. Peters on the Thirteenth day of July, 1862, in Co K 5th E. Tennessee Vols as a Private (In all the proof in this claim please refer to the mother's claim on file.) and served at least ninety days in the war of the Rebellion in the service of the United States, who was HONORABLY DISCHARGED June the 12, 1865, and died March the 8th 1890. That he left a widow surviving him who is still living. That the mother was married under the name Hulda A. Cross to John H. Peters, there being no legal barrier to such marriage. Murphy of Knoxville, Tenn. her true and lawful attorney to prosecute this claim and receive a fee of ten dollars. That her post office address is Scarboro, County of Anderson, State of Tenn. (signed) Hulda A. Peters (wit.) W. W. Grubb, S.A. Grubb Also personally appeared W. W. Grubb, residing at Scarboro Tenn and S.A. Grubb, residing at Scarboro Tenn persons whom I certify to be respectable and entitled to credit, and who, being duly sworn, say that they were present and saw Hulda A. Peters, the claimant, sign her name to the foregoing declaration; that they have every reason to believe, from the appearance of said claimant and their acquaintance with her for 8 years and 25 years respectively, that Hulda A. Peters is the identical person She represents herself to be; and that they have no interest in the prosecution of this claim. Sworn to and subscribed to me this 30 day of January, A.D. 1904.
